1. Acceptance of Terms
By accessing or using the Dynamic CX platform ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
Dynamic CX Ltd ("we", "us", or "our") provides this Service subject to these Terms, our Privacy Policy, and any additional agreements or addenda (collectively, "Agreement").
2. Use of the Service
You must:
- Be at least 18 years old or have legal capacity to enter into a binding agreement
- Provide accurate and up-to-date information when creating an account
- Use the Service only for lawful purposes and in accordance with this Agreement
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3. Subscription, Billing & Payments
The Service operates on a subscription and usage-based model. Pricing, add-ons, and renewals are described on our website and may change with notice.
All fees are billed in GBP (£) unless otherwise specified and are non-refundable, except as required by law. Subscriptions renew automatically unless cancelled prior to the next billing period.
4. Acceptable Use
You agree not to:
- Use the Service to store or transmit unlawful, harmful, or infringing content
- Interfere with or disrupt the integrity or performance of the Service
- Attempt unauthorised access, reverse engineering, or security testing
- Use automated tools (bots, scrapers, etc.) to access data without consent
We reserve the right to suspend or terminate accounts violating this clause.
5. Intellectual Property
All intellectual property rights in the Service, including software, design, text, graphics, and AI-generated outputs (excluding your input data), remain the property of Dynamic CX Ltd or its licensors.
You retain ownership of your data but grant us a limited licence to host, process, and display it solely to provide the Service.
6. Data Protection
We process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing and represent that you have the right to provide any data uploaded to the platform.
7. Service Availability & Updates
We strive for 99.9% uptime, but availability may vary due to maintenance, upgrades, or factors beyond our control. We may modify or discontinue features with reasonable notice.
We are not liable for loss of access due to external factors, including internet outages, cloud service failures, or force majeure events.
8. Limitation of Liability
To the fullest extent permitted by law:
- Dynamic CX Ltd is not liable for indirect, incidental, or consequential damages.
- Our total liability in any 12-month period will not exceed the amount paid by you for the Service during that time.
- We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.
9. Termination
You may terminate your account at any time through your admin dashboard or by contacting support@d-cx.com.
We may suspend or terminate accounts for breach of these Terms or unlawful activity. Upon termination, your data will be handled in accordance with our Privacy Policy.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
